Welcome to IBS Pal. These Terms of Use ("Terms") govern your use of the IBS Pal mobile application (the "App"), operated by AKEN LTD, a company registered in the United Kingdom ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. About AKEN LTD

IBS Pal is a product of AKEN LTD, registered in the United Kingdom. All references to "we", "us", or "our" in these Terms refer to AKEN LTD.

3. App Usage Terms

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable local, national, or international law or regulation.
• Reverse engineer, decompile, or disassemble the App or any portion thereof.
• Attempt to gain unauthorized access to the App, its servers, or any systems or networks connected to the App.
• Use the App to transmit any harmful, offensive, or inappropriate content.
• Use the App in any manner that could disable, overburden, damage, or impair the App.

4. Subscription Terms

IBS Pal may offer subscription-based features or services. By subscribing, you agree to the following:

• Billing: Subscriptions are billed on a recurring basis (monthly, annually, etc.) as selected at the time of purchase.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You may cancel your subscription at any time through your device's subscription settings.
• Refunds: Refunds are handled in accordance with the applicable app store's refund policy.
• Price Changes: We reserve the right to change subscription prices with reasonable advance notice.

5. Medical Disclaimer

IMPORTANT: IBS Pal does not provide medical advice, diagnosis, or treatment. The App is designed to provide informational content only and is not a substitute for professional medical advice, diagnosis, or treatment.

You should always:

• Consult with a qualified healthcare provider before making any health-related decisions.
• Never disregard professional medical advice or delay seeking it because of information provided in the App.
• Seek immediate medical attention if you experience any medical emergency.

The information provided by the App is based on general dietary guidelines and may not be suitable for all individuals. AKEN LTD is not responsible for any health consequences resulting from the use of the App.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• AKEN LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
• AKEN LTD makes no warranties or representations about the accuracy, reliability, completeness, or timeliness of the content provided in the App.
• The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
• In no event shall AKEN LTD's total liability to you exceed the amount you paid to AKEN LTD in the twelve (12) months preceding the event giving rise to the liability.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of AKEN LTD and are protected by United Kingdom and international copyright, trademark, and other intellectual property laws.

8. User Content

The App may allow you to create, submit, or store content such as food logs, symptom tracking, and other personal data. You retain all rights to your content. By using the App, you grant AKEN LTD a limited license to use, store, and process your content solely for the purpose of providing the App's services to you.

9. Termination Rights

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe:

• Violates these Terms or applicable law.
• Is harmful to other users, AKEN LTD, or third parties.
• Is otherwise inappropriate.

You may terminate your use of the App at any time by deleting the App from your device and discontinuing use. Upon termination, you may request deletion of your account and data by contacting us.

10. Data Privacy

Your use of the App is also governed by our Privacy Policy, which can be found at privacypolicy.html. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

12. Changes to These Terms

We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or on our website with a new effective date. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

13. Third-Party Services

The App may contain links to or integrate with third-party services, websites, or applications. AKEN LTD is not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AKEN LTD regarding your use of the App and supersede all prior agreements and understandings.
